Why do I need a Will?

It has been reported that 57% of the population don't have a will...

  • Without a will your assets may not pass to who you wish.
  • The deceased's family may end up paying thousands in inheritance tax.
  • Your children may end up with no inheritance at all.
  • If you live with your partner but aren't married they could end up with nothing.
  • Without making a will you are potentially passing up on the opportunity for tax planning.

Where there's a Will...

The loss of a family member can be one of the most difficult times of our lives. In addition to the emotional strain there is the pressing need to deal with your loved one's assets and to administer their estate. This can be a tremendous burden to take on alone and many people turn to professionals for help.

What is Probate?

On death, an individual's assets will be frozen by their bank. Before closing a bank account, the bank will want to be sure that they are giving the proceeds to the person with authority.

The person with authority is the Executor. The Executor must prove he has authority by obtaining a Grant of Probate.

Once Probate is obtained the assets must be collected in and distributed. Ultimately, the Executor has a duty to account to the beneficiaries of the Will for all monies which have passed through the estate from the date of death to the time when the beneficiaries receive their inheritance.
